Portland brokers saw mortgage meltdown loom; federal report hints it could happen again | LoanWorkout.org

In February 2004, future Federal Reserve Chairman Ben Bernanke penned a paper titled “The Great Moderation,” a celebration of a sunny new era of economic stability. Deregulation and “increased depth and sophistication of financial markets” were in part responsible for the decline in economic volatility, he wrote.

It’s too bad that Bernanke wasn’t with me at the Elephants Deli on Kruse Way in 2005. I was meeting a mortgage broker on that sun-drenched afternoon. The housing market was running flat-out and the mortgage industry was awash in money. But he was miserable.

The broker talked in apocalyptic tones about frighteningly sloppy lending that had become pervasive. He told me about a new kind of wink-wink, nudge-nudge home loan in which the lender made no effort to verify the applicant’s purported income.

He laid it all out — the whole daisy chain of the modern mortgage industry that had convinced itself, and the outside world, that it could spin garbage into gold.

I didn’t get it. I failed to grasp the destructive potential of the industry’s new go-go mentality. And I blithely walked away.

I offer this anecdote not only as mea culpa, but also to illustrate one of the central truths of the just-issued congressional report from the Financial Crisis Inquiry Commission. The financial meltdown that has ruined so many lives was not caused by an uncontrollable, unanticipated convergence of events. This was a largely predictable and avoidable crisis caused by the breakdown of traditional practices and discipline in the financial industry.

Had Bernanke or his predecessor, Alan Greenspan, bothered to ask, even rank-and-file brokers here in Portland would have given them an earful about the looming catastrophe.

The commission’s 600-plus page report spares no one. The mortgage industry, the big banks, Wall Street, the ratings agencies, Fannie Mae and Freddie Mac and the regulators all take a pounding.

“The captains of finance and the public stewards of our financial system ignored warnings and failed to question, understand and manage evolving risks within a system essential to the well-being of the American public,” the majority report states in its executive summary.

We’re now a poorer country, with diminished expectations to match our diminished buying power. But have we learned anything? Are we in a better position to avoid the next economic bubble?

More people suing banks over foreclosures

Struggling Bay Area homeowners are joining an emerging national trend by suing banks for breaking contracts when the lenders refuse to make temporary loan modifications permanent - even though owners have done their part.

The lawsuits reflect growing frustration among homeowners who believe that banks are treating them unfairly, and they follow failed attempts by the government to force lenders to fully consider modifications before foreclosing. The suits have twin goals: to make mortgage modifications stick, and to raise the national profile of such cases so banks reform their practices.

Lawyers who filed class-action suits in U.S. District Court in San Francisco last year against JPMorgan Chase and Wells Fargo are expecting rulings in the coming months that will determine whether their claims can move forward.

The official U.S. government report on what caused the financial crisis released Thursday cast blame on Goldman Sachs for fueling the subprime mortgage bubble, Merrill Lynch for not telling investors about the true state of its financial condition and the Federal Reserve for failing to stop troubling practices.

The report from the Financial Crisis Inquiry Commission, a congressionally appointed panel that has spent the past 18 months investigating the causes of the financial crisis, spares virtually no one in assigning culpability for the worst financial calamity in generations.

Released to the public online and in the form of a 633-page paperback, the report at first does not appear to contain any major revelation that would fundamentally alter the narrative of the crisis that has been written by journalists and authors in numerous publications. But it weaves together many different strains, fueled by the commission's subpoena power, which allowed it to garner the testimony of dozens of insiders and review the internal documents of federal regulators and banks alike.

"This report exposes facts, identifies responsibility, unravels myths and helps us understand how this crisis could have been avoided. It is our best attempt to record history, not to rewrite it, nor allow it to be rewritten," said commission chairman Phil Angelides, the former treasurer of California, at a news conference Thursday morning.

The commission said it referred potential violations of law to the Justice Department or to state attorneys general, but did not provide more specifics.

Lawsuit claims fraud by Bank of America mortgage unit | Dayton Business Journal

A new allegation claims Bank of America's Countrywide mortgage operation committed "massive fraud" in a lawsuit by big investors who say they were misled about the quality of mortgage-backed securities.

A dozen institutional investors, including TIAA-CREF Life Insurance Co. and New York Life Insurance Co., filed the complaint Jan. 24 in New York state Supreme Court, according to Bloomberg News.

The litigation is the latest salvo in a battle between BofA (NYSE: BAC), which has several mortgage loan offices in the Dayton region, and institutional investors over mortgage-backed securities and the quality of the loans backing those investments.

The prolonged mortgage crisis that has confronted the U.S. housing industry since 2008 has regulators poised to crack down on loan servicers with a proposed list of new requirements.

Federal Deposit Insurance Corp. chair Sheila Bair on Wednesday called for the establishment of a foreclosure claims commission and outlined steps to streamline the loan-modification and foreclosure processes.

"It is time for government and industry to reach an agreement that will finally bring closure to the crisis and pave the way for a lasting recovery in our housing and mortgage markets," Bair said in a speech at the Mortgage Bankers Association conference in Washington, D.C. "If we fail to act decisively now to deal with the foreclosure crisis, we risk triggering a double-dip in U.S. housing markets that could roll back the progress the program has made to date."

The foreclosure rate has climbed steadily nationally and locally since the housing slump began in 2008. Savannah's foreclosure rate peaked at 1.9 percent in September 2010, according to real estate analysis firm CoreLogic, and the delinquency rate remains above 6 percent.

Local real estate and mortgage industry insiders applauded Bair's proposals Wednesday.

Any measure that can decrease the number of foreclosures and help guide distressed borrowers would be beneficial to troubled homeowners and the market as a whole, said Monica Spillane, president of the Savannah Area Board of Realtors.

"Fewer foreclosures on the market would improve pricing obviously," Spillane said. "But the other part of the foreclosure crisis is people are scared. You hear all these things about what's going on with both the economy and the problems with the process, and you don't want to make a purchase. And that's a detriment to our community."

Galvin seeks foreclosure tribunal - The Boston Globe

Massachusetts Secretary of State William F. Galvin is calling for the Legislature to create a special tribunal to deal with homeowners’ concerns about foreclosures, following Friday’s ruling by the state’s highest court that puts into question the ownership of thousands of properties repossessed by lenders.

Lawmakers should recommend that the state’s Land Court appoint a judge to oversee hearings for owners of foreclosed homes who are worried about the validity of their property titles, Galvin said. A tribunal could also address questions from financially troubled homeowners about whether banks have the legal right to seize their properties, he said.

“There is a lot of uncertainly out there,’’ Galvin said of the foreclosure crisis. “We can’t let this sit here for months and fester.’’

The proposal follows a Supreme Judicial Court ruling that upheld a Land Court decision invalidating two Springfield foreclosures because the lenders could not prove they held the property titles at the time they took back the homes.

Friday’s 6-to-0 decision is expected to increase pressure on major US lenders to prove they own mortgages before foreclosing and gives people seeking to keep their homes additional reason for legal action. As a result of the ruling, lenders will have to redo the paperwork for an undetermined number of foreclosures. In cases where someone was wrongly foreclosed upon, banks could be forced return a property to its former owners.

Fed up with the foreclosure chaos, the New Jersey courts demanded that banks prove the integrity of their home repossession systems or face shutdown.

To demonstrate the need for the Dec. 20 order, New Jersey cited flaws in six Florida foreclosure cases, including three in Palm Beach County, as examples.

In Nevada and Arizona, attorneys general last month sued Bank of America for a dual-track foreclosure system that offers homeowners hope with a loan modification, while at the same time taking away the home in court. Called deceptive and labeled consumer fraud in the lawsuits, the practice is also prevalent in the Sunshine State.

And on Friday, the Massachusetts Supreme Court issued a bombshell ruling against banks' ability to foreclose on homes - a decision could reverberate nationwide.

The moves by other states to address the foreclosure morass has Florida homeowner advocates and defense attorneys asking why more isn't being done here.

It only took him a second to sign each foreclosure document.

That's how good Tam Doan got at his job in Bank of America's pre-sale foreclosure department in Southern California.

Of course, he didn't have time to actually read the paperwork he was signing, he said, and in some cases, he didn't even know what documents he was putting his pen to.

"I had no idea what I was signing," said Doan. "Either you were in or you were out."

The recent revelation that loan servicers had employees sign thousands of documents a month without verifying the information has thrown the foreclosure system into chaos. Judges are increasingly questioning whether the servicers have their paperwork in order.

Massachusetts Supreme Court voids foreclosures - Jan. 7, 2011

The Massachusetts high court ruled on Friday that two foreclosures are invalid because the banks could not prove they had the proper paperwork to foreclose.

The banks "failed to make the required showing that they were the holders of the mortgages at the time of foreclosure," Justice Ralph Gants wrote for the Massachusetts Supreme Court.

This could be a harbinger of things to come because it is the first ruling by a state high court on the issue of whether banks can foreclose on homeowners if can't prove they hold the mortgages.

Numerous instances of this emerged last fall, as evidence appeared that banks were robo-signing foreclosure documents without actually reading them. As a result, there are dozens of similar cases in lower courts across the country, all waiting for the Massachusetts Supreme Court ruling.

House Democrats are pushing for new regulations to crack down on the frequently foreclosure practices that have been dominating headlines for months. Several crucial Democrats in the House are circulating a letter urging support for the new regulations. The letter, drafted by Rep. Brad Miller (D-NC), encourages federal banking regulators to restrict practices at bank divisions called "mortgage servicers." Servicers are responsible for collecting and processing payments, charging late fees, negotiating with troubled borrowers and implementing the foreclosure process. Servicers have been criticized for committing widespread fraud in recent months, charging improper fees and incorrectly evicting borrowers. The latest example was seen on Wednesday where a California woman filed a lawsuit against Bank of America, stating that the broke into her home, threw out all of her possessions, including her dead husband’s ashes, and changed her locks even though she was in the midst of a mortgage modification. Unfortunately, cases like these are becoming more commonplace.
